The Site is provided by 1 People LLC ("1 People", "we" or "our"). By creating an account or otherwise accessing or using the Site, you acknowledge and agree to follow and be bound by these Terms.
Any new features, tools, products or services which are added to the current store shall also be subject to the Terms. You can review the most current version of the Terms at any time on this page. We reserve the right to update, change or replace any part of these Terms by posting updates and/or changes to our Site. It is your responsibility to check this page periodically for changes. Accordingly, we will not provide you with any notice, if we decided to update, change or replace any part of the Terms. Your continued use of or access to the Site following the posting of any changes constitutes acceptance of those changes.

If you make a purchase at the Site, it is subject to these Terms, 1 People Returns Policy, 1 People Warranty Claim Process, 1 People Payment Method Policy, 1 People Cookie Policy, and 1 People Privacy Policy, which are hereby incorporated into and made part of these Terms. By submitting your information and order you agree to these Terms and the foregoing incorporated policies by reference.
4. Payment Method
You will be able to elect the method of payment available on our Site, please review 1 People Payment Method Policy. For any purchases you represent and warrant that you have the legal right to use the selected payment cards or other payment methods used in connection with the purchase.
5. Availability

6. Product Information
We are not responsible if the information we made available on the Site is not accurate, complete or current. We will make all reasonable efforts to accurately display the attributes of a product, including the applicable colors; however, the color you see will depend on your monitor or mobile device resolution and system. We cannot guarantee that your computer will accurately display such colors.

8. Price Errors
The price listed on the Site for our products are provided as a good faith effort to list the prices we intend to charge upon receipt of your offer. Despite such effort, errors may occur in the prices listed for a product. In the event of a price error, we reserve the right to decline to sell or accept your offer at the listed price, even if you have completed the checkout process.
9. Order Offer and Acceptance
The products listed on the Site is not an offer to purchase the product. They are an invitation for you to make an offer to purchase such product listed on the Site. By completing the checkout page it creates an offer by you to purchase the product. An offer is only deemed accepted by 1 People, if we have completed and shipped your order.
You receipt of an electronic or other form of confirmation does not mean or constitute 1 People’s accept of you offer and order, nor does it mean or constitute a confirmation of an offer to sell by 1 People. As such, we reserve the right to accept or decline your offer for any reasons or for no reasons at all.
10. Sales Tax
Sales tax for orders within the United States or other countries will be determined and charges as of the time of shipping. Sales taxes listed during the checkout process may not be accurate. We reserve the right to make adjustments to the amount charges for the sales tax at any time to reflect the correct chargeable sales tax amount.
11. Return of Product
In limited circumstances, 1 People will accept the return of a product purchased through this Site within 365 days of the date of purchase and either refund you the amount paid for the product or exchange the product. To qualify for a refund or exchange the requirements outlined under 1 People Return Policy must be met and followed. 1 People does not offer a return and refund for products concerning underwear and facemask, and swimwear (if the hygiene seals on the swimwear has been removed). 12. Intellectual Property Rights
All material on the Site, including text, audio, design, graphics, video, software, and derived therefrom (collectively “Content”) are owned, controlled, or licensed by 1 People or its subsidiaries and affiliates, and are subject to and protected by United States and international copyright and intellectual property laws and rights. All rights to the Content not expressly granted in this Terms are expressly reserved to their respective owners. Except as expressly authorized by these Terms, you may not; copy, reproduce, distribute, republish, download, perform, display, post, transmit, exploit, create derivative works or otherwise use any of the Content in any form or by any means, without the prior written authorization of 1 People or the respective copyright owner.
In addition, any trademarks, service marks, trade names, trade dress and logos contained or described on the Site are the sole property of 1 People and/or its licensors and may not be copied, altered or otherwise used, in whole or in part, without the prior written authorization by the owner such mark.
Any use of the Site and material downloaded by you is at your own discretion and risk. In no event will 1 People be responsible for any damage to your devices or computer system or loss of data that is caused by the download of any such material by you.
1 People hereby grants to you a limited license to access and use the Site and the Content for your personal and non-commercial use.
13. Use of Site
You may be required to create an account on the Site in order to enjoy certain features and promotions, such as Loyalty program, affiliate program, or other related programs. For any information you provide, you agree to provide accurate, true, and complete information about yourself, and keep such information up to date. 1 People may suspend or terminate your account or access to the Site or any features (including royalty programs), if 1 People has reasonable ground to suspect that the information you have provided is inaccurate, false or outdate.
If you create an account, you will be required to create a username and password. You are sole responsible for keeping the password and account confidential and any activities that stems from your password and account activities. If you discover unauthorized use or actives or any breach of security you agree to promptly notify 1 People of such breach and unauthorized activities. You further agree to use the Site only for lawful purposes and you agree not to post or transmit through the Site any immoral content, illegal content, infringing, defamatory, profane, hateful or otherwise material of any kind that violates any laws or regulations. You will be solely responsible for any communication posted on the Site.
14. Loyalty Program
You may, if eligible, join 1 Peoples’ Loyalty Program and receive the benefits outlined under the Loyalty Program. In addition to the Terms, the specific terms and conditions for the Loyalty Program will also apply to your enrollment and use of the Loyalty Program. 15. Feedback and Review
You will be able to leave review and feedback of the Site and/or our products listed on the Site. In this regard, we do not solicit, nor accept confidential or proprietary information. Accordingly, your submission of any comments, feedback, information or other material will be deemed not to be confidential or secret.

These links are provided only as a convivence for you, and 1 People does not control, nor endorse any third party websites or content on the such websites. You agree and acknowledge that 1 People is not responsible or liable for any content, goods, service provided outside of this Site or through another website. Furthermore, you hereby made aware that other websites may contain harmful, illegal, misleading, offensive, inaccurate, defamatory, and untrue information and material. As such, any use of third party links are at your own risk.
17. Policy on Discounted Items
Items purchased at a discounted rate are final sale and cannot be returned or refunded. Additionally, shipping charges apply to all orders of discounted products.
18. Disclaimer and Limitation of Liability
We do not guarantee, represent or warrant that your use of our Site will be uninterrupted, timely, secure or error-free.
The Site, including all contents and services, made available through the Site is provide “as is” and “as available”. 1 People, its parent, subsidiary and other affiliated companies, and their respective officers, directors, employees and other representatives (collectively, the "1 People Group"), expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.
In no event, shall 1 People Group be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products delivered to you from our store or procured by using or store, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or product or any content posted, transmitted, or otherwise made available via the service, even if advised of their possibility.
NOTWITHSTANDING THE FOREGOING, TO THE FULLY EXTENT PERMITTED BY LAW, THE SOLE AND ENTIRE MAXIMUM LIABILITY OF 1 PEOPLE GROUP FOR ANY REASON, AND YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY CAUSE OR CLAIM WHATSOEVER, SHALL BE LIMITED TO THE AMOUNT PAID BY YOU FOR ANY PRODUCT, INFORMATION OR SERVICE PURCHASED BY YOU FROM 1 PEOPLE THROUGH THIS SITE.
The limitation under this section 17 is a comprehensive limitation of liability that applies to all damages of any kind, including any direct, indirect, special, incidental or consequential damages, whether based on breach of contract, breach of warranty, tort (including negligence), product liability or otherwise, even if an individual advises of the possibility of such damages. The limitations of liability set forth herein are fundamental elements of the basis of the bargain between 1 People and you. Accordingly, the products, information and services offered on and through the Site would not be provided, if it were not for such limitations set forth hereunder.
Some jurisdictions may not allow the disclaimer of certain warranties or limitation or exclusion of liability for certain types of damages. Part of the above limitations or disclaimers may therefore not apply to you. In these circumstances, where we may not, as a matter of law, limit our liability or disclaim warranties, the extent of our liability and extent and duration of the warranty, will be the minimum as permitted under the law that applies.
19. Limited Product Warranty and Disclaimer.
For all products purchased on or through the Site, 1 People Group warrants the products are free of flaws in material or workmanship within a period of 3 years from date of purchase. EXCEPT FOR THE FOREGOING LIMITED WARRANTY, TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, 1 PEOPLE GROUP DISCLAIM ALL WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, ANY IMPLIED WARRANTIES, WITH RESPECT TO THE PRODUCTS AND SERVICES LISTED ON THE SITE OR PRODUCTS AND SERVICES PURCHASED ON OR THROUGH THE SITE. WITHOUT LIMITATION TO THE FOREGOING, 1 PEOPLE GROUP EXPRESSLY DISCLAIM ALL LIABILITY FOR PRODUCT DEFECT OR FAILURE OR CLAIMS CAUSED BY NORMAL WEAR (INCLUDING BREAKDOWN OF COLOURS AND MATERIAL), PRODUCT MISUSE, ABUSE, PRODUCT MODIFICATION, IMPROPER PRODUCT SELECTION, AND NON-COMPLIANCE WITH ANY PRINTED DIRECTIONS.
All claims concerning the foregoing limited warranty, must be made pursuant to the process outlined in 1 People Warranty Claim Process Policy.
1 People reserves the right to reject your limited warranty claim, if you do not follow 1 People’s instructions or 1 People Warranty Claim Process Policy or 1 People’s request for information or if 1 People determines the warranty claim is not covered by the limited warranty. However, if 1 People accept the claim, 1 People will, at its discretion, repair the product or replace the product. The foregoing will be your sole and exclusive remedy and warranty for the flaws in material or workmanship. Any repairs or replacement of product performed under the warranty will not extend the limited warranty in any way. Accordingly, the 3 years warranty from the date of purchase will continue to run, even if the product is replaced or repaired.
Some jurisdictions may not allow the disclaimer of certain warranties or limitation or exclusion of liability for certain types of damages. Part of the above limitations or disclaimers may therefore not apply to you. In these circumstances, where we may not, as a matter of law, limit our liability or disclaim warranties, the extent of our liability and extent and duration of the warranty, will be the minimum as permitted under the law that applies.
20. Indemnity
You agree to indemnify, defend and hold harmless 1 People Group against all claims, demands, causes of action, losses, expenses, damages and costs (including any reasonable attorneys' fees), resulting or arising from or relating to; (a) your use of or conduct at the Site; (b) any activity related to your account by you or any other person; (c) any material that you submit to, post on or transmit through the Site; (d) your breach of these Terms; (e) your infringement or violation of any rights of another; or (f) termination of your access to the Site.
21. Termination
1 People may terminate or suspend your access or part of the Site, without any form of notice, for any conduct 1 People, in its sole discretion, believes is in violation of these Terms or any laws or is harmful to 1 People Group or any other Site users. In the event of any termination or suspension, you will continue to be subject to section 12 (Intellectual Property Rights), section 17 (Disclaimer and Limitation of Liability), section 18 (Limited Product Warranty and Disclaimer.), section 19 (Indemnity), and section 21 (Miscellaneous)
22. Miscellaneous
In the event that any provision of these Terms is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms, such determination shall not affect the validity and enforceability of any other remaining provisions.
The failure of 1 People Group to insist upon strict adherence to any term of these Terms shall not constitute a waiver of such term and shall not be considered a waiver or limit that party's right thereafter to insist upon strict adherence to that term or any other term contained in these Terms.
All obligations and liabilities of the parties incurred prior to any termination or expiration of these Terms, and all provisions that by their nature should survive termination, shall survive any termination or expiration of these Terms.
